Terms of Service

1. Agreement to Terms

By accessing or using Noshling ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the App. These Terms apply to all visitors, users, and others who access or use the App.

2. Description of Service

Noshling is a meal planning application designed to help parents plan nutritious meals for babies aged 6 months to 3 years. The App provides meal planning tools, recipe suggestions, grocery lists, and nutritional tracking features. Some features require a paid subscription.

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. The App is intended for use by adults (parents or guardians) only.

4. Subscription and Payment

Subscription Plans

Noshling offers both free and premium subscription plans:

• Free Plan: Limited access to recipes and one meal plan per week
• Premium Monthly: $4.99 per month with full access
• Premium Annual: $39.99 per year with full access

Billing

Premium subscriptions are billed through your Apple ID account. By subscribing, you agree to:

• Pay all applicable fees for your selected plan
• Automatic renewal unless cancelled at least 24 hours before the end of the current period
• Price changes with 30 days notice for existing subscribers

Free Trial

New users are eligible for a 1-month free trial of Premium features. You will not be charged during the trial period. If you do not cancel before the trial ends, you will be automatically charged for your selected subscription plan.

Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Refunds are handled according to Apple's App Store policies.

5. Acceptable Use

You agree not to use the App to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Create multiple accounts for fraudulent purposes
• Resell or commercially exploit the App's content without permission

6. Intellectual Property

The App and its original content, features, and functionality are owned by Noshling and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our App or its content without our express written permission.

User Content

By creating custom recipes or meal plans in the App, you retain ownership of your content but grant Noshling a non-exclusive, worldwide, royalty-free license to use, store, and display your content for the purpose of providing the service.

7. Medical Disclaimer

Important: The information provided in Noshling is for general informational purposes only and should not be considered medical or nutritional advice.

• Always consult with your pediatrician before introducing new foods to your baby
• The App is not a substitute for professional medical advice, diagnosis, or treatment
• We are not responsible for any adverse reactions or health issues
• Individual babies may have unique dietary needs and restrictions
• If your baby has allergies or medical conditions, seek professional guidance

8. Limitation of Liability

To the maximum extent permitted by law, Noshling shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the App
• Any unauthorized access to or alteration of your data
• Any content or conduct of any third party on the App
• Any errors or omissions in the App's content
• Personal injury or property damage resulting from your use of the App

9. Indemnification

You agree to defend, indemnify, and hold harmless Noshling and its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of a third party.

10. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the App and informs users of our data collection practices. By using the App, you consent to the data practices described in our Privacy Policy.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to access or use the App after revisions become effective, you agree to be bound by the revised terms.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in California, and you hereby consent to personal jurisdiction and venue therein.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding the App and supersede any prior agreements.
